Thistle & Nest, a developer, is challenging the Bend tree protection code and has submitted two applications to build 28 homes between Pettigrew Road and Daly Estates Road, about 100 yards north of Reed Market Road. They have refused to comply with the code, stating it is not clear and objective. The City replied with a Notice of Incomplete Application and issued a decision setting conditions of approval that Thistle & Nest submit a full tree inventory and designate how it proposed to comply with the required tree preservation formula on each site. Thistle & Nest has until April 28 to appeal the City’s decision to the Land Use Board of Appeals (LUBA).
